    Hello, I'm DaveOlden, and I live in Victoria BC, Canada. I've been a member of this Cantina since September, 2014, and a Star Wars fan since the summer of 1977.

    I'm an aspiring illustrator and storyteller...

    On December 11th, stepping into a parking lot, my foot caught on an unseen branch, and I fell hard.

    My forehead impacted pavement, and my left wrist broke.

    There was surgery on the wrist on December 14th.

    December 23rd, at the Orthopaedic Surgeon's, x-rays were taken, and a fibreglass cast applied...

    Recovery time to get full use of my hand back will be anywhere between "3 and 6 months". There will be physiotherapy, which will need to be paid for. I will be billed for the cast, and there will be other costs I don't have bills for yet...

    My pharmacy told me (on the 23rd) my pain prescription (Tramacet) is not covered. That's $57. I don't have that. Without pain meds, it has taken, on average, 6 hours for me to get to sleep each night.

    I do not have food or money. Proper nourishment is, of course, ESSENTIAL, especially for a body trying to mend, and regain strength.

    I can't prepare meals (ie, I cannot open a can with one hand). I have not eaten, and need prepared meals.

    I have no means of transportation, yet I need to pay for SAFE travel and other daily living expenses.

    I live alone, in a small room in a rooming house, and do not have family support. No one to help with driving me around, nor help to feed me, or to assist with daily needs.

    I am left to help myself, without the strength or finances ... without the resources to do so.

    Yes, I am considering a claim against the property owner where the injury occured. But I have no lawyer.

    Even if a lawyer can be found who will take this on, it is not a guaranteed case. From a lawyer who turned down the case, in his final email: "From my perspective it will be an uphill battle persuading a Court that there is something negligent in this situation.”

    So even with a lawyer, it will be a long and difficult case. It could easily take months (or years).

    Yet it comes back to my immediate needs. Mounting medical bills, transportation, meals.... and other living expenses...

    I am asking, here, for your help... however you can.

    UPDATE: Spoke to another Lawyer today. He hasn't said (yet) that he won't be taking me on... but he was very clear that it would be very, very difficult to find fault or negligence. (And if they argue they're not responsible in any way.... why compensate me at all?)
    And even if there was money, it wouldn't be enough to make most lawyers want the case.

    The legal claim is going to be long hard "uphill" fight, with no guarantees.

    It's good thing this fundraising campaign is under way now.

    He's a managing partner at his firm, specializing in "civil litigation" and "insurance law". He has been practising at this firm since 1993.
    His name is well known here in town, in fact, he suggested to me that recognition might help the claim along a bit

    At this point, you need to find out if they have any sort of insurance at all. You need to make sure that the business has "premises liability insurance." Go back to the place of the accident and take pictures to PROVE that there weren't any adequate safeguards. Prove the owner of the property knew of prior negligence possibility, the owner blatantly ignored your claims, prove you weren't being a reckless idiot. Most lawyers will tell you that it's an uphill battle but not all
    Hope is lost. On this day, you will destroy the owner and get the insurance money you need to get better !

    Starbucks is only a tenant. We know that the Property Management company (that they lease from) has insurance. (I have been told to expect a call from their "insurance broker" soon). All this is part of filing an insurance claim.
    To file a claim I absolutely need a lawyer.
    I took thorough pictures of the site day after I was out of surgery (Dec 15th), and those pictures have been provided to today's lawyer.
    But from those same pictures, another (also well placed) lawyer said, "I see no signs of negligence."
    Which is why every lawyer is calling this a difficult "uphill" case.
    It will be months.

    I have not eaten, and it will be the same for the coming weeks...

    Did you take pictures IMMEDIATELY after it happens? That would have helped loads. Don't wait for them to call, you call THEM. I telling you, before I was worth anything, no one even looked at me. You need money to be looked at seriously .you need to be doing your own background and going DIRECTLY to them...it's supposed to be public knowledge from city hall or even Yelp .

    Immediately after the injury I was in EXTREME PAIN with a BROKEN WRIST and head trauma.. trying to stay conscious while paramedics attended to me.
    What should I have said? "Sorry guys... all this medical attention will have to wait... we need pictures!" ?

    I've had my head split open twice. The first time, I had spent $5,000 building Star Wars armor in a brand new 50K Lexus. I got hit, the car flipped and spun around 3 times. Some old couple got out of the old beat up Honda that hit me and flagged down a card the driver of that car throws me A Dora the Explorer Towel and says, - I blast you not - "clean yourself up, kid." I was sent to the hospital for a week, had 64 stitches, with half of them being internal and NOT dissolvable . I still took pictures and posted them to Facebook to be safe . . . It turned out the old

    Well, that's certainly true for me, and would explain why no one here locally is helping. I'm certainly worth nothing (bank account is $15 overdrawn... so that's less than nothing).

    I am not in any shape to do all this...

    I mean, wee all worth SOMETHING, and you shouldn't thing of yourself as "worthless" no matter what . I think I vaguely remember you saying how your family isn't even helping. For me, no ones ever helped me with anything when I've needed it, even now, but our community is way more
    Friendly than any sort of bank lends for Sally may or Freddie frellig Mac .

    Financially worthless. (Although self worth is taking a beating here, too ("here" where I am, I mean -- not the forums)...)
